Abstract

Generic drugs play a critical role in healthcare systems worldwide by improving patient access to affordable medications while maintaining the same standards of quality, safety, and efficacy as innovator products. In Canada, the regulation of generic drugs is governed by the Food and Drugs Act and the Food and Drug Regulations under the oversight of Health Canada. The approval process for generic drugs involves rigorous scientific evaluation to ensure pharmaceutical equivalence and bioequivalence with a Canadian Reference Product (CRP). Manufacturers seeking approval must submit an Abbreviated New Drug Submission (ANDS) containing comprehensive data on quality, safety, efficacy, and bioavailability. Recent regulatory developments have focused on clarifying the eligibility criteria for the ANDS pathway, particularly concerning therapeutically active components, pharmaceutical equivalence, and alternative Canadian Reference Products. The proposed amendments aim to improve access to high-quality generic medicines while enhancing transparency, consistency, and regulatory efficiency. Special considerations apply to radiopharmaceuticals, biologics, labelling requirements, data protection provisions, and patent linkage regulations. The Notice of Compliance (NOC) and Drug Identification Number (DIN) issued by Health Canada serve as essential regulatory approvals authorizing market entry. This review comprehensively examines the Canadian regulatory framework governing generic drugs, including legislative requirements, review processes, pharmaceutical equivalence standards, Canadian Reference Products, safety and effectiveness considerations, data protection mechanisms, and recent regulatory reforms. Understanding these requirements is essential for pharmaceutical manufacturers, regulatory professionals, healthcare practitioners, and policymakers involved in generic drug development and approval in Canada. The evolving regulatory landscape continues to support innovation while ensuring the availability of safe, effective, and affordable generic medicines for Canadian patients.
